Prime Minister can Dissolve the House of Representatives: Advocate Badri Bahadur Karki

Senior advocate Badri Bahadur Karki has claimed that the majority prime minister will be able to dissolve the House of Representatives. However, he acknowledged that their numbers were not enough to defeat President Conte's government. Karki, who was present at the constitutional session as an amicus curiae, claimed that the 2072 constitution did not remove the right to dissolve. He informed that the right of dissolution in Article 53 (4) of the Constitution of 2047 BS is silent in Article 85 of the Constitution of 2072 BS.

Judge Anikumar Sinha asked him if he was kept silent or not. In reply, Karki said that section 85 is also silent and section 76 (7) is also silent. Judge Sinnha asked him, "How is the system of silence activated?"

In response, senior advocate Karki said that he would be active in dissolving the Prime Minister of 76 (1). He said, "If the parliament fails, it will be dissolved as per Article 76 (7) and if the government fails, it will be dissolved as per Article 85."
